The present general sales terms and conditions (hereinafter “GST&C”) will be applicable to the online store, owned by the mercantile company Esencia Califal Gourmet, SL, (hereinafter the Seller) being this company responsible for the marketing through the website indicated of extra virgin olive oil and condiments prepared under the trademark “Esencia Califal”.

The company reserves the right to modify these general conditions, as well as the list of products and prices at any time, not applying these modifications to orders already placed.

Items are available until end of stock. In case we are unable to attend your order because it is not available in our warehouse, we will contact you as soon as possible.

The company reserves the right to reject any order even if it is already paid, proceeding the company to the full refund of the order amount by the same form of payment for which it was made.

General definitions:

For the purposes of these General Sales Terms and Conditions:

“General Sales Terms and Conditions”:  A document detailing the general and specific conditions that a seller offers to a buyer for the supply of goods or services.

“Client”: Any natural person of legal age or legal person who holds the status of consumer according to the applicable regulations and who formalizes an order for products through the online store Esencia Califal.

“Seller”: Esencia Califal Gourmet, S.L., is a mercantile company whose main activity consists in the sale of extra virgin olive oil and prepared condiments.

“Products”: All the products offered on the website

“Website, online store or platform” Esencia Califal: The domain is owned by the Seller for the online sale of its products offered on the website.

“Order form”: Document for placing the order, which is the purchase of the products offered on the website indicated above.


These GST&C regulate the sale process between the contracting parties (buyer and seller) of the products offered by the latter through the online store established on the website, constituting the legal framework that develops the present contractual relationship.

The characteristics and prices of the products are those published on the website indicated above, except for monographic errors. The prices indicated include VAT, and are the prices in force for as long as they are published on the website.

Way to pay

The customer can choose, when placing the order, the most convenient payment method: credit or debit card supported by the website secure payment gateway or by bank transfer. In case of choosing the bank transfer payment method, the customer must indicate the order number in the concept of the transfer.

Payment through deferred procedures such as cash on delivery or any other procedure to those allowed and specified by the seller in these conditions of sale will not be accepted.

The order is processed once the company confirms that it has received the payment. However, the order received after 14:00 H. will be processed the next business day.

Shipments and deliveries

In general, shipments will be made by logistics companies subcontracted by the seller who will deliver the order within 5 business days always depending on the delivery location, as well as the dates or general transport situation, counting these days since the company has the approval of payment of the order that will start the preparation of the order. In the event that the order cannot be delivered within the established period of time, the company will contact the customer to determine the action to be taken.

For purchases over 75€ transport cost is included.

The orders will be supplied by the seller in closed, resistant packaging and suitable for the content and logistical requirements.

The delivery address of the order will be established by the customer, and the delivery address may not coincide with the billing address.

In the absence of the Customer or the recipient of the order, the carrier will place it on delivery the next business day.

The seller is not responsible for a return produced by an error in the address indicated by the customer or for the impossibility of making the delivery at the address indicated in the purchase form, the customer must bear the cost of a new order delivery.

The signature of the delivery note, or in absence, the documentary confirmation by our transport suppliers will imply the acceptance of the delivered products.

The transport services are external to Esencia Califal Gourmet, S.L., so any failure to meet the delivery deadline or information about the delivery as mentioned are not their responsibility. However, the seller will make every effort to comply with the delivery conditions indicated above.

Purchasing process

To make the online purchase in the online store, the customer must fill in the order form established for this purpose.

Once the order form has been completed and the purchase process has been completed as well, the customer will receive an e-mail confirmation about the successfully order placed, which will include a detailed summary of the purchased items, the total price of the order, customer details, billing and shipping.

To the order delivery, a copy of the delivery note will be given detailing the batch number of each product delivered.

These GST&C defined by the company are understood as accepted once the company is aware of the order payment, made through some of the payment methods that makes available to customers.


The prices applicable to the products offered in the online store will be those published on the website indicated above, except for monographic errors, which include VAT. (VALUE ADDED TAX), or, where applicable, the corresponding charge being the prices in force for as long as they are published on the website.

The amount of the product, VAT and shipping costs, or any other expense that may be applicable will be detailed breakdown to the customer when placing the order.

 Offers and promotions

Offers and promotions that may be in effect simultaneously are not cumulative. The system will automatically establish the most advantageous offer or promotion to the customer.

Products features

Products features are those published on the website indicated above, except for a monographic or photographic error. If any of the aforementioned errors may occur, being outside the will of the seller, we will proceed to the immediate remedy.

Regardless the care taken to the products description, as well as their photographic reproduction, their characteristics may be modified, for which the seller will indicate it when receiving the order confirmation.

Complain process and return conditions

Any anomaly, non-delivery of products or damage that occurs during shipment must be indicated on the delivery note and confirmed by mail to within 10 calendar days of receipt of the order.

The seller will proceed to replace or return the orders according to the procedure as described below:

The customer must contact by email at detailing the return request product, the reason for the return request and the delivery note number. If you may do not have the delivery note, you must indicate the name and surname or company that placed the order, always detailing the lot of the product purchased for verification and identification in our traceability system.

We will contact the customer within a period of no more than 3 working days.

Returns of items unsealed or after 10 days from the delivery date will not be accepted.

The original packaging must be in perfect condition, as well as all its accessories in order to be returned.

The return of the order must be made through a courier company to the following address: C / Simón Carpintero, Parc. 94, Nave, 14014, Córdoba (Córdoba). The merchandise will be received at the seller’s facilities with a maximum period of 14 business days.

The cost of shipping in case of return will be borne by the customer.

The refund of the order will be made in the same way in which the payment was made.

Data Protection

In accordance with article 13 of the General Data Protection Regulation (Regulation (EU) 2016/679 of April 27, 2016 regarding the protection of natural persons with regard to the processing of personal data and the free circulation of these data) we inform you that the seller as the customer data treatment responsible, will inform the customer that the final use of his data is in order to manage the order as requested at the online store, including the commercial and courtesy notifications within the framework of the aforementioned business relationship.

Equally, your data will be transferred in all cases where it is necessary for the development, compliance and control of the relationship with our entity and the provision of services derived from it or in the cases in which it is authorized by a regulation with the rank of law.

In compliance with the Spanish LOPD, you can exercise your rights of access, rectification, deletion, opposition, limitation and portability of your data by going to the following address: Calle Simón Carpintero, Parc. 94, Nave 4, 14014 Córdoba or sending an email to: attaching a copy of your ID.

Governing law and jurisdiction

The present GST&C will be governed and interpreted in accordance with the Spanish implementing legislation, specifically, by the provisions of Law 7/1998, of 13 April, on General Conditions of Procurement, Spanish Royal Legislative Decree 1/2007 approving the Consolidated Text of the General Law for the Protection of Consumers and Users, EU Regulation 2016/679 of the European Parliament and the Council of 27 April 2016 (GDPR) Organic Law 3/2018, 5 December, on Protection of Personal Data and guarantee of digital rights, and Law 34/2002, 11 July, on Information Society Services and Electronic Commerce.

Any dispute arising from the interpretation or execution of these GST&C shall be submitted to the Courts and Tribunals of the city of Córdoba, unless another jurisdiction is established under the current regulations.
